Delhi Court passed Permanent Injunction against PLUS OZONE in a suit of Ozone Overseas based on its brand OZONE.

 

On 22 July 2024, the Hon’ble District Judge of Commercial Court of West Delhi, Tis Hazari Courts ruled in favour of Our Client, Ozone Overseas Pvt. Ltd (“the Company”) and passed a decree of permanent injunction against an entity namely Classic Glass & Hardware, Hyderabad (“Ex-dealer” / “Defendant”), from using the trademark “PLUS OZONE” for hardware products.  The suit was filed by the Company in the year 2019 against an ex-dealer based on the Company’s well-established and reputed Trademarks OZONE / OZONE PLUS for hardware goods. Our Senior Partner, Mr. Surinder Singh Advocate represented the Plaintiff, Ozone Overseas Pvt. Ltd.

 

 

DELHI HIGH COURT PASSED INTERIM INJUNCTION AGAINST ZAVENTIS / ZAVENTIS HEALTH CARE PRIVATE LIMITED IN A SUIT OF ZUVENTUS HEALTHCARE LIMITED BASED ON ITS BRAND ZUVENTUS

 

On 5 July 2024, the Hon’ble High Court of Delhi passed an Interim Injunction against Delhi base Company, Zaventis Health Care Private Limited (“the Defendant”)  in a suit filed by Our Client, Zuventus Healthcare Ltd (“the Plaintiff”). The Hon’ble Court, after hearing the matter, passed an ex-parte, ad-interim injunction restraining the Defendant from using ZAVENTIS as trademark and/or part of trade name /domain name www.zaventis.com in any manner, particularly and including Pharmaceuticals and medicinal products which is amounting to infringement/passing off of the plaintiffs registered trademark/trade name and copyright.

NAYASA GROUP, INDIA FILED THE CANCELLATION PETITION AGAINST AUSTRALIAN COMPANY PUNJAB IMPORTS PTY LTD. TO CANCEL TRADEMARK “NAYASA” IN AUSTRALA

 

NAYASA GROUP, being renowned organization in the field of Household products and Kitchen utensils as well as proprietor of the trademark NAYASA worldwide, filed a cancellation Petition before the Australian Trademark Office against the Registered Trademark NAYASA of Punjab Imports Pty Ltd, an Australian Company. The Cancellation has been filed on the basis of bad faith adoption and no bona fide use. Nayasa Group has alleged in its Cancellation Petition that Punjab Imports is not the owner of the trademark NAYASA for Household Products and Kitchen utensils and obtained the said registration by making false declarations before the Registrar of Trademarks, Australia. The matter is pending for adjudication before the Registrar of Trademarks, Australia.
